Florida has robust public health infrastructure dedicated to HIV care, largely funded by federal Ryan White grants. If you test positive, you will have access to life-saving antiretroviral therapy (ART) regardless of your insurance status or ability to pay.

🏥 The Diagnosis Pathway

Receiving a positive diagnosis triggers an immediate, structured response from the healthcare system.

  1. Confirmatory Testing: A rapid test is only an initial indicator. Your provider will immediately draw blood for a confirmatory lab test.
  2. Rapid Start: Florida prioritizes the "Test and Treat" (Rapid Start) model. The goal is to start you on ART within 24 to 72 hours of a preliminary diagnosis, often before the confirmatory labs return. This protects your immune system immediately.
  3. Linkage to Care: If you tested at an LGBTQ+ clinic (like Care Resource or Metro Inclusive Health) or the Florida Department of Health (FDOH), they will assign you a case manager. This person is your navigator. They handle the bureaucracy of getting your medication paid for.

💵 Paying for Medication (ADAP & Ryan White)

HIV medications are incredibly expensive, but almost no one pays the cash price.

  • Insured Patients: If you have an ACA marketplace plan or employer insurance, your medication is covered. The manufacturer (e.g., Gilead or ViiV) provides co-pay assistance cards that usually bring your pharmacy cost down to $0.
  • Uninsured Patients (The Medicaid Gap): Because Florida did not expand Medicaid, the AIDS Drug Assistance Program (ADAP) is the critical safety net. Administered by the FDOH and funded by the Ryan White CARE Act, ADAP covers the full cost of ART for low-income, uninsured Floridians. Your case manager will enroll you.

Florida has severe laws regarding the disclosure of HIV status. It is crucial to understand your legal obligations.

The Law (Statute 384.24): In Florida, it is a felony to have sexual intercourse without informing your partner of your HIV-positive status prior to the encounter.

Does U=U protect you legally?

Medically, if you are Undetectable, you are Untransmittable (U=U). You pose zero risk of passing the virus to a partner. However, legally, Florida law has not yet caught up to the science. The statute criminalizes non-disclosure regardless of your viral load, whether you used a condom, or whether transmission actually occurred.

While advocacy groups are fighting to modernize these laws, you must be aware that an undetectable viral load is not currently a legal defense for non-disclosure in Florida.
